New Salesperson.... any advice

I washed a roof last year for a guy that had done a lot of research about roof cleaning and was interested in the opportunity.

With that said, he could not have been happier with the results of the work we did. By the time I left, he told me he had a son who would be great at roof cleaning and wanted to know how much money I needed to form this partnership. I told him I was not interested in a partnership and never would be. Long story short, he is a 65 year old retired insurance salesman. Now he is doing sales for me. So far so good, he started two weeks ago and has ten roof cleanings scheduled. 

What do I need to do in order to cover my own a$$? Non-compete agreement I would assume. Any other suggestions?

just a non compete should be suffice just have a lawyer draw it up to match your company.

Is he gaining these jobs by leads generated by you or is he out getting his own leads?

Yes, he is going door to door. He sold insurance in the community of 13,000 for 15 years and know a lot of people. When we agreed for him to do this, I was going to be happy if could get me 25 roofs this year. Hell, last year was my first year and I did 45-50 and this year I already have 19 scheduled (10 him, 8 for me) with 1 done. I am really excited for the weather to cooperate and start washing roofs.

Pay em 15% residential and 10% for commercial. Give him a per mile allowance if he uses his own ride. If he's good you'll know it in a few weeks.

I guess I should have stated that he was calling me this morning (sunday) at 6:30. Through the week, I don't so much care when he calls.

Gary, I am happy to work 9-2 everyday. If I can make a good living working banking hours, I am more than happy. haha But, I also understand I am going to work my tail off while I am young so I dont have to when I am older.

I need a salesman myself. I go to the gym early so I need a mid morning nap. Then I need time to goof around here and Facebook. Then its lunchtime. Then maybe add a blog posting somewhere if theres still time after that. So as you see, I have a hectic schedule.

I hear ya Ed. I really had no intentions of getting salesman. It just happened to turn out that way. I like to do things at my own pace on my schedule. This sales guy (65 years old) thinks its ok to call me (28 years old) at 6:30 in the morning to talk shop. We now have a rule...no calls before 9 unless it's an emergency! haha

Hi Mike... I'm not very keen on using the word ... employee.... unless he will be an employee, with you deducting taxes, etc.... In PA, you need to cover employees with workmans comp.

If he is a subcontractor, or salesperson on commission... state that instead.

In NJ you still have to cover for workers comp even if they are a subcontractor or salesman, UNLESS they have their own workers comp that you will have to keep on file for a workers comp audit. I just got audited for workers comp last month. Salesman also but at a lower rate. An in-house salesman even lower. You have to negotiate the insurance co.

I would do the sub-contractor. I also would not let him know what chemicles we used so I probably wouldn't do a non-compete.

If he is selling the job some people(customers) want to know what chemicals are being used and he would need to know in order to be able to explain that they are safe and approved thru the shingle manufacture.
