This is also why we as business owners need to have Employee training (SOP and Safety) as well as all safety logs filled out daily. An employee that knows the laws could play you and your business all the way to the ground..... Head first from that 40ft ladder without a hard hat lol.

I'm confused... how does this situation have anything to do with employee training and safety logs? The employee in the video never did anything to that HVAC company. It was the other driver's insurance company and scum sucking lawyers going after the deeper pockets of a commercial insurance policy. Unfortunately, this could happen to anyone, in business or not.

I think he was just generalizing the fact that the many scenarios do exist and employees as well as other people do this kind of suing. But all in all the lawyers do not care anyways. They will sue as long as make money whether right or wrong.
The many stories if you have had the chance to view the site are so diverse and in day to day operations, I want this to be in the back of our( Randy& I ) minds to pay extra careful in things we do. Making sure that ladder is secured right etc. In being new to this business, I try to think of situations we may come across and how to prevent as best as we can the liability. We have had a great record for roofing for 28 years and intend to keep it that way.

Brett, In my past I worked as a manager for a manufacturing company. Every year we would have to sit through 2 days of training with a Corp. lawyer out of Columbia SC. We learned many many things that would scare the begisis out of most business owners.

One of the main points is DOCUMENTATION. All businesses including yours falls under OSHA regulations plain and simple. There are people, possibly a future employee of yours or mine that wants to play the system. It is general knowledge that ladders must have an inspection log, AND all employees that use said ladder must have been properly trained to use and inspect that ladder.

Now enters an employee that needs some money, or just looking for a free ride. (Did we do the background check and followup with previous employers to see what kind of person he or she really is? Could save a business allot of trouble) This employee sees that you have no training program, no logs etc. they take a fall from a ladder on purpose, just enough to get hurt but not too hurt. Now they bring in the lawyer and take everything you own. (You own a Corp. so your personal assets are safe...... NOT in a negligence case which this would be. ALL your supposed assets are now fare game for litigation)

Brett, I'm not pointing this at you man.... I'm just throwing out the real world Chit that goes on every day.

As AC said..... RCIA will not certify Law Breakers. Not having logs and training is breaking the law. Guys are claiming being in business 10,15,20 years and they don't have or need this stuff. They ARE breaking the law. One day it may catch up to them. It only takes One accident and everything they own, and have worked so hard for will be lost. I hope No one here on the RCIA ever has to go through that.

Please understand the real world laws and regulations your business should be following. I'll bet 80% of the guys out here are not following all the laws and regulations, not because they don't care, but because they DON'T KNOW.

The RCIA Certification will contain/cover allot of the compliance issues for you. You just need to understand that they are already REQUIRED by your company weather you are doing them or not.

I'm just trying to get everyone to sit back...... and really look at your business from a compliance stand point and be honest, and write down your non compliance issues or were you may need some improvement.

Where do we find out what Employee training and logs are necessary?

What are all of the safety and inspection logs that have to be filled out daily and how do you learn about them and the proper way to fill them out?

Where did you find the proper way to train employees to use and inspect that ladder.

You can go to osha.gov and find all rules and regulations. As far as training matl. I have always created my own training or SOP Matl. Training does not have to be a whole day event. You just need to be sure an employee understands what you are teaching them, and you have to document (Have them sign a training matrix etc.) the event. There is allot of training matl. online you could just make your own as well. Much of this WILL be covered by the RCIA when a standard for certification is decided on. No RCIA member will be left in the dark, as long as they are keeping up with the ongoing events.

You do not need to take their classes. Please don't think you need to. Yes there is allot of info on the OSHA site. It does take some time to sort through. When the certification standards are finalized, they will contain info on everything we need to comply with as far as DOT and OSHA compliance. RCIA will also have options as to how and were we get the info, and how to apply it to our business. If you are concerned about your current standing with complience, you will need to research, or call OSHA, and find out the requirements for your particular business. I hope this helps you out some? There is a STICKY about Safety Tips I started. There is most of the information there or at least a link to more info. If I can help with anything, please drop me a PM, I'll be glad to help if I can.
